Labor Day Insights: Reflecting on Wealth’s Role in Family Legacies

Posted by Scott Lynett, Esq. | Sep 05, 2025 | 0 Comments

Like many families in Northeast Pennsylvania, my great-grandfather started his career as a breaker boy, picking slate from the coal mined beneath Scranton. Over the course of a lifetime, he built a thriving business and made significant, lasting contributions to our community. His values of hard work, risk-taking, and sacrifice still drive me every day.

As you reflect on Labor Day and the celebration of values like those of my great-grandfather, it's natural to think about what you're working toward, and more importantly, what you're leaving behind. For many families, the fruits of a lifetime of labor are not just measured in wages or retirement accounts, but in the legacy of financial stability, values, and opportunity passed down to future generations.

Wealth Is More Than Dollars and Cents

When we talk about “wealth,” it's easy to focus only on bank balances and investments. But true wealth encompasses much more. It represents the home that holds your family's history, the business you built from the ground up, and the traditions and stories that give those assets meaning.

Take, for example, the family that owns a modest rental property purchased decades ago. To the outside world, it may look like just another investment. But to the family, it represents years of saving, sacrifices made to send children to school, and the foundation of future financial security. Protecting and properly transferring that kind of wealth ensures the story continues, without conflict or unnecessary financial loss.

In Pennsylvania, this kind of foresight is critical. For example, Pennsylvania is one of the few states that imposes an inheritance tax on most transfers after death. Even children who inherit from a parent's estate face a 4.5% tax. Without planning, a family home or investment property could be diminished by this tax obligation. Proper strategies, such as lifetime gifting or trusts, can help minimize that burden.

Avoiding Family Strain Through Planning

Too often, families put off estate planning because it feels overwhelming or because life is simply too busy. Yet, just as generations before us worked hard to create stability, it's our responsibility to make sure that stability continues. Without a plan, inheritances can be diminished by taxes, assets can become tangled in probate court, and even close-knit families can experience strain.

For instance, imagine three siblings who inherit a family vacation cabin. Without clear instructions from their parents, disputes over upkeep costs, usage schedules, or whether to sell the property can easily erupt. With thoughtful planning, such as placing the property in a trust or creating an agreement outlining responsibilities, parents can prevent these conflicts and preserve harmony.

Pennsylvania law provides some unique tools as well. For example, the Family Exemption allows a surviving spouse or dependent child living in the home to claim up to $3,500 of estate property free of inheritance tax. While modest, this exemption can help ease the immediate financial burden of loss. Knowing these details, and planning with them in mind, can make a meaningful difference.

Protecting the Results of a Lifetime of Work

Every Labor Day, we honor the dignity of work. Estate planning is one way to honor the results of that work. Whether your legacy is a business you've grown, retirement savings you've carefully invested, or simply the family home, proper planning ensures your loved ones are cared for and that your values carry on.

And in Pennsylvania, where even jointly owned property and bank accounts can have tax consequences at death, the value of proactive planning cannot be overstated. Simple steps, such as ensuring deeds are titled properly or designating beneficiaries on accounts, can spare your loved ones unnecessary costs and stress.

Reflecting and Taking Action

Labor Day reminds us of the efforts of past generations and the opportunities they've created. Now, in the days after the holiday, it's the perfect time to reflect: What legacy am I building? How can I ensure that my family's future is as strong as its past?
