The Transition into Adulthood Happens Faster Than We Think
As a father of three children myself, I understand how emotional and exciting the transition to college can be for families. One moment you are helping your child learn to ride a bike, and the next you are helping them pack for a dorm room hours away from home.
For many parents, preparing for college means shopping for supplies, discussing class schedules, and making sure tuition payments are in order. However, one of the most important conversations families often overlook has nothing to do with academics at all.
Once your child turns eighteen, they are legally considered an adult. That means parents no longer automatically have the authority to make medical or financial decisions on their behalf, even in an emergency.
This comes as a surprise to many families.
What Happens if There is an Emergency?
Imagine your child is away at college and unexpectedly ends up in the hospital after an accident or serious illness. As a parent, your instinct is to step in immediately and help. However, without the proper legal documents in place, hospitals and medical providers may be limited in what information they can share with you.
Similarly, if your child becomes temporarily unable to manage financial matters, you may not have the authority to assist with bank accounts, insurance issues, housing matters, or other important responsibilities.
This is where Financial Powers of Attorney and Healthcare Directives become incredibly important.
A Healthcare Power of Attorney allows your child to designate someone they trust to make medical decisions if they are unable to communicate for themselves. A HIPAA Authorization can also allow parents or other trusted individuals to access medical information and speak with healthcare providers.
A Financial Power of Attorney allows a trusted person to assist with financial or administrative matters if needed. This can include handling banking issues, signing documents, or helping manage unexpected situations while your child is away at school.
Real Life Situations Families Often Do Not Expect
Many parents assume these documents are only necessary for older adults, but we regularly see situations where younger adults benefit from having them in place.
For example, one family had a child attending college several states away when she experienced a sudden medical emergency and required surgery. Her parents quickly discovered that obtaining medical updates and assisting with certain decisions became far more complicated because no healthcare documents had been prepared in advance.
In another situation, a college student studying abroad lost access to his bank account after suspected fraud activity. Because he had previously signed a Financial Power of Attorney, his parents were able to assist in resolving the issue quickly while he focused on school and travel logistics.
These are not situations families like to imagine, but planning ahead can make difficult moments significantly less stressful.
A Simple Step That Provides Peace of Mind
The good news is that these documents are typically straightforward to prepare and can provide tremendous peace of mind for both students and parents.
Having these conversations can also be a meaningful part of preparing your child for adulthood. Rather than taking away independence, these documents simply create a safety net in the event something unexpected happens.
As parents, we spend years trying to prepare our children for the future. While we hope emergencies never occur, having the proper legal documents in place can help ensure that families are able to support one another when it matters most.
Preparing Your Family for the Next Chapter
Sending a child off to college is one of life's biggest milestones. It is exciting, emotional, and often bittersweet for parents and students alike. Taking the time to put these important documents in place can provide reassurance that your family is prepared for the unexpected while your child begins this exciting new chapter.
